1. DEFINITIONS AND INTERPRETATION
1.1 In these Terms and Conditions (“Terms”):
- “Company”, “we”, “us”, or “our” means TKOH Limited, trading as Vision Aquatics, registered in the United Kingdom under company number 15688915.
- “Customer”, “you”, or “your” means any individual or entity using the Website or purchasing Goods from the Company.
- “Website” means www.visionaquatics.co.uk.
- “Goods” means any products offered for sale via the Website, including livestock where applicable.
- “Contract” means the legally binding agreement formed between you and the Company in accordance with Clause 6.
- “Policies” means the Privacy Policy, Cookies Policy, Returns & Livestock Policy, and Delivery Information published on the Website.

3. APPLICATION OF TERMS AND POLICIES
3.1 These Terms govern: (a) use of the Website; and
(b) all Contracts for the sale of Goods purchased via the Website.
3.2 These Terms must be read in conjunction with the Policies, which form an integral part of the Contract.
3.3 In the event of any conflict, the relevant Policy shall prevail only in respect of the subject matter it governs.
3.4 By using the Website or placing an order, you confirm acceptance of these Terms and the Policies.
4. GOVERNING LAW AND JURISDICTION
4.1 These Terms and any Contract are governed by the laws applicable within the United Kingdom.
4.2 Consumers may bring proceedings in the courts of the UK country in which they reside.
4.3 Nothing in these Terms limits statutory consumer rights.
4.4 The Company sells and delivers Goods only within the United Kingdom.
5. WEBSITE USE
5.1 You agree to use the Website lawfully and not to misuse, interfere with, or attempt unauthorised access.
5.2 The Company reserves the right to suspend, restrict, or terminate access to the Website or a Customer account where misuse, abuse, or breach of these Terms is reasonably suspected.
6. FORMATION OF CONTRACT
6.1 Placing an order constitutes an offer to purchase Goods.
6.2 An Order Acknowledgement Email confirms receipt only and does not constitute acceptance.
6.3 A Contract is formed only when a Dispatch Confirmation Email is issued.
6.4 The Company may refuse any order prior to dispatch. Where payment has been taken, a full refund will be issued.
7. AVAILABILITY OF GOODS
7.1 All Goods are subject to availability.
7.2 If Goods become unavailable after an order is placed, the Company may offer an alternative or issue a full refund.
7.3 The Company shall not be liable for indirect or consequential losses arising from unavailable stock.
8. PRICES AND PAYMENT
8.1 Prices are shown in Pounds Sterling (£) and include VAT where applicable.
8.2 Delivery charges are displayed at checkout.
8.3 Prices may change prior to order acceptance.
8.4 In cases of obvious pricing error, the Company reserves the right to cancel the order and refund payment.
9. DELIVERY, RETURNS AND LIVESTOCK
9.1 Delivery methods, timeframes, inspections, cancellations, and returns are governed by the Delivery Information and Returns & Livestock Policy.
9.2 Livestock (including corals) is subject to specific conditions set out in the Returns & Livestock Policy.
9.3 Nothing in this Clause affects statutory consumer rights.
10. RISK AND OWNERSHIP
10.1 Ownership of Goods passes upon full payment and delivery.
10.2 Risk passes to the Customer upon delivery.
10.3 Customers must inspect Goods immediately upon receipt.
11. WEBSITE CONTENT AND ACCURACY
11.1 Product descriptions and images are provided for guidance only.
11.2 The Company does not guarantee that Website content is free from errors.
11.3 Liability for reliance on Website content is limited in accordance with Clause 20.
12. INTELLECTUAL PROPERTY
12.1 All Website content is owned by or licensed to the Company.
12.2 Content may be viewed or printed for personal, non‑commercial use only.
12.3 Commercial use without written consent is prohibited.
13. CUSTOMER ACCOUNTS AND DATA
13.1 Customers are responsible for maintaining the confidentiality of account login details.
13.2 All personal data is processed in accordance with the Privacy Policy.
13.3 Cookies and tracking technologies are governed by the Cookies Policy.
14. ARTICLES, DATABANKS AND GUIDANCE
14.1 Information provided is for general guidance only and does not constitute professional or veterinary advice.
14.2 Use of such information is at the Customer’s own risk.
15. USER CONTENT AND ONLINE GALLERY
15.1 Responsibility for user‑submitted content rests with the contributor.
15.2 The Company does not guarantee accuracy or suitability of such content.
16. PRICE MATCHING
16.1 The Company does not offer price matching, including for livestock or plants.
17. GIFT CARDS AND CREDIT NOTES
17.1 Gift Cards are redeemable in‑store only and valid for two (2) years.
17.2 Gift Cards are non‑refundable and cannot be exchanged for cash.
17.3 Credit Notes are valid for six (6) months and redeemable in‑store only.
18. FREE GIFTS AND PROMOTIONS
18.1 Free gifts are non‑refundable and non‑exchangeable.
18.2 Where an order is refunded, any free gift must be returned or paid for at its current selling price.
19. WEEE REGULATIONS
19.1 The Company complies with UK Waste Electrical and Electronic Equipment Regulations.
19.2 Like‑for‑like recycling is available where originally purchased from the Company.
20. LIMITATION OF LIABILITY
20.1 Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded by law.
20.2 Subject to Clause 20.1, the Company shall not be liable for indirect or consequential losses, loss of profits, or events beyond reasonable control.
21. FORCE MAJEURE
21.1 The Company shall not be liable for any failure or delay in performing its obligations where such failure or delay results from events beyond its reasonable control, including but not limited to acts of God, extreme weather, courier disruption, industrial action, power failure, or governmental restrictions.
22. ASSIGNMENT
22.1 The Company may assign, transfer, or subcontract its rights and obligations under these Terms without affecting your statutory rights.
22.2 You may not assign or transfer your rights or obligations without the Company’s prior written consent.
23. SEVERABILITY
23.1 If any provision of these Terms is found to be unlawful, invalid, or unenforceable, the remaining provisions shall remain in full force and effect.
24. ENTIRE AGREEMENT
24.1 These Terms, together with the Policies, constitute the entire agreement between you and the Company and supersede all prior communications, representations, or agreements, whether written or oral.
25. OPERATING DAYS AND CUSTOMER SERVICE
25.1 Vision Aquatics operates Wednesday to Sunday, excluding Bank Holidays.
25.2 Customer service communications may not be monitored outside these days.
